Welcome to the Creative Compass Solution! By accessing or using the Creative Compass Solution (as defined below), you are entering into an agreement with Coolex HK Limited ("Creative Compass", "us", "we", "our"), under which you will be bound by the following terms of service (the "Terms"), as updated from time to time in accordance with Section 3. The term "you", "your" or "User" refers to the person or entity browsing, accessing or otherwise using the Creative Compass Solution ("use" or "using" in these Terms will mean any of the foregoing).
The "Creative Compass Platform" is our online platform that: (a) is a marketplace that facilitates interactions between third parties who offer agents which provide services using artificial intelligence ("AI") to perform one or more categories of tasks ("Agents"), and individuals and entities wishing to access such Agents; (b) provides access to and use of Agents; and (c) provides an environment for third parties to create Agents to be made available on the Creative Compass Platform.
By agreeing to these Terms, you represent that you have reached the age of majority in your jurisdiction (if applicable), you have the capacity to enter into binding obligations, and all information you supply to us is true, accurate, current and complete. If you are using the Creative Compass Solution on behalf of a business or other entity, you represent and warrant that you have the necessary authority to bind that business or entity to these Terms and that you are agreeing to these Terms on behalf of that business or entity. If you do not agree to be bound by these Terms you must not use or access any part of the Creative Compass Solution and should delete your account(s) with us.
These Terms will govern your access to and use of: (a) the Creative Compass Platform, including our website located at https://icreative.ai and all associated subdomains (collectively, the "Website"); (b) any other services provided by Creative Compass in connection to the provisioning of the Creative Compass Platform; and (c) the Agents made available by us on our own behalf (collectively, the "Creative Compass Solution"). Subject to your compliance with these Terms, you may use the Creative Compass Solution in accordance with any documentation or guidelines we make available to you.
You may use the Creative Compass Solution in the capacity of any of the following categories of User, including a combination of any of these categories:
To access certain features of the Creative Compass Solution, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
You agree not to use the Creative Compass Solution to:
The Creative Compass Solution, including all content, features, and functionality, is owned by Coolex HK Limited and is protected by copyright, trademark, and other intellectual property laws.
You retain ownership of any content you submit to the Creative Compass Solution, but you grant us a license to use, modify, and distribute such content as necessary to provide our services.
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the Creative Compass Solution.
Certain features of the Creative Compass Solution may require payment. All fees are non-refundable unless otherwise specified. We reserve the right to change our pricing at any time with reasonable notice.
You agree to pay all charges incurred by your account. If payment is not received by the due date, we may suspend or terminate your access to paid features.
To the maximum extent permitted by law, Creative Compass shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.
Our total liability for any claims arising from or related to these Terms or the Creative Compass Solution shall not exceed the amount you paid to us in the twelve months preceding the claim.
Either party may terminate these Terms at any time. We may suspend or terminate your access to the Creative Compass Solution immediately if you violate these Terms or for any other reason at our sole discretion.
Upon termination, your right to use the Creative Compass Solution will cease immediately, and we may delete your account and all associated data.
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Creative Compass Solution after such changes constitutes acceptance of the new Terms.
